As a photojournalist, my work is a matter of public record, protected by the First Amendment of the U.S. Constitution and compliant with the journalistic exemptions of the General Data Protection Regulation (GDPR). My practice adheres to the NPPA (National Press Photographers Association) Code of Ethics and the standards of international news agencies.
1. Access and Public Interest (Legal Standing)
I operate under the principle that events of public interest occurring in publicly accessible spaces—including businesses during operating hours and advertised gatherings—are subject to documentation.
• US/PA Standard: Under Pennsylvania law, entry into a business open to the public is an implied license.
• EU Standard: My processing of visual data is conducted under the “Journalistic Purpose” exemption (Art. 85 GDPR), where the public’s right to information is balanced against individual privacy.
2. The Expectation of Privacy vs. The Public Record
I respect the “reasonable expectation of privacy” (as defined by 42 Pa. C.S. § 8316 and ECHR Article 8). However, this expectation is diminished in common areas and events of public concern.
• While I respect a property owner’s right to revoke access, I maintain that the act of recording a newsworthy event in a common space is a protected exercise of press freedom. Any request to cease documentation will be met with a professional inquiry into the legal basis of the request.
3. Editorial Independence and Integrity
In accordance with Reuters and Philadelphia Inquirer ethics policies, my editorial process is independent of the subjects I document.
• The Capture Phase: I document the scene as it exists, without staging or intervention, to ensure an accurate historical record.
• The Editorial Phase: The determination of “newsworthiness” is an editorial decision made post-capture. I do not allow subjects or third parties to censor the “record of the moment” before it has been evaluated for its contribution to the public discourse.
4. Commercial vs. Editorial Usage
I strictly distinguish between Editorial and Commercial use.
• My work is produced for informational, educational, and journalistic purposes. Therefore, Model Releases are not required for individuals captured in the context of newsworthy events or in public view.
• I do not authorize the use of my editorial imagery for advertising, endorsement, or trade without separate, explicit consent, protecting the “Right of Publicity” for all subjects.
5. Accountability and Professional Dialogue
A free press is accountable to the community it serves. I operate with transparency and am committed to accuracy and context.
• Direct Resolution: I request that any concerns regarding the context, accuracy, or impact of a published image be addressed directly to me.
• Ethical Review: I am always open to a professional dialogue regarding the ethical framework of a specific image. This “open-door” policy ensures that while the integrity of the public record is maintained, the human impact of journalism is never ignored.
